Voucher Terms of Use
TERMS OF USE SWISS ACTIVITIES VOUCHERS
General All deliveries and services provided by Swiss Activities AG, including related online orders and other online services, are subject to these General Terms and Conditions (GTC). Any deviations and/or additional agreements require explicit approval from the management of Swiss Activities AG and must be in writing; this also applies to any waiver of the written form requirement.
Vouchers For online vouchers, it should be noted that they are issued to the customer by Swiss Activities AG with a secure anti-counterfeiting code. Since the customer can print the voucher themselves, multiple printouts are possible, but only one printout is valid and redeemable. The first voucher redeemed with the corresponding code is considered the original and must be debited by Swiss Activities AG immediately upon redemption. If further copies with the same code appear, this constitutes abuse and may have criminal consequences. There is no entitlement to fulfilment and/or delivery or to damages from Swiss Activities AG if anyone attempts to redeem multiple vouchers with the same code, even if the first redeemer is not the rightful owner of the voucher. In such cases, legal action for forgery can be initiated against the issuer with fraudulent intent. Since vouchers can be transferred or gifted, Swiss Activities AG is neither obligated nor able to verify the entitlement of the redeemer. When redeeming, only the voucher number's validity in the system and whether the voucher has been paid for will be checked. Vouchers are generally valid for 2 years (see date and validity on the voucher). After this period, Swiss Activities AG is no longer obliged to accept the voucher. Lost vouchers will not be replaced. Vouchers cannot be exchanged for cash value. If the voucher's value exceeds the service consumed, Swiss Activities AG will credit the remaining balance in full on future visits or consumption. In such cases, no claim exists for a payout of the remaining voucher amount. Swiss Activities AG is not obliged to accept unpaid vouchers as payment. For operational reasons, the services listed on the voucher can only be provided or guaranteed if a timely and appropriate reservation has been made, especially for vouchers related to overnight stays and group vouchers. The service described on the voucher may vary slightly depending on circumstances but must not significantly reduce the value for the guest. Should Swiss Activities AG close or cease operations for any reason, the vouchers expire without compensation. This also applies if ownership of the business demonstrably changes. In such cases, Swiss Activities AG as the original issuer cannot be held liable.
Products All products offered by Swiss Activities AG are provided with the utmost care and diligence. Product images on the online shop may differ slightly from the actual products in terms of colour, shape, or size, but this does not constitute a defect. The technical data and descriptions provided for each product are decisive. Swiss Activities AG reserves the right to remove products from the range or replace them with new ones at any time.
Delivery Swiss Activities AG will endeavour to adhere to agreed or specified delivery times. Should delays exceed six weeks, the customer has the right to set a grace period with notice that they refuse acceptance after expiry of this period. The grace period must be at least one month. If no agreement on a new delivery date is reached after this period, the customer may withdraw from the contract in writing after expiry of the grace period. Claims for damages due to delay or impossibility of delivery are excluded. This also applies to claims for lost profits or other indirect damages. Further claims of the buyer, especially for delivery and any risks or side effects related to the product, are excluded. Risk passes to the customer once the goods are handed over to the carrier and have left the warehouse or business premises, even if Swiss Activities AG has paid transport costs. Complaints about transport damage must be made by the customer to the transport company within the prescribed period. For shipments from the customer, all risks, including transport risk, are borne by the customer until the goods arrive at Swiss Activities AG. If the ordered goods are unavailable for reasons beyond Swiss Activities AG's control (e.g., a supplier failing to meet contractual obligations), the customer will be informed immediately. In such cases, Swiss Activities AG is entitled to withdraw from the contract. Any payments already made will be refunded promptly. Further claims of the customer are excluded.
Payment You can choose to pay by invoice or credit card. When paying by credit card, the amount will be charged immediately to the chosen card. Swiss Activities AG invoices are payable immediately without deduction. From the 30th day after the invoice date, the company may charge interest on arrears at 5%, unless Swiss Activities AG proves higher interest or the buyer proves lower charges. Cheques are accepted only as a means of payment; any fees incurred are borne by the customer. Offsetting is only allowed with undisputed or legally established claims. The customer can only assert a right of retention if it is based on the same contractual relationship.

Defects Complaints regarding delivery scope, defects, wrong deliveries, and quantity deviations that are detectable through reasonable inspection must be submitted promptly, but no later than one week after receipt of the goods or vouchers, in writing. For justified complaints, Swiss Activities AG will correct incorrect deliveries free of charge and, subject to any exclusion clauses, will at their discretion exchange products or vouchers, take them back, or grant a price reduction. If a replacement voucher is also defective, the buyer has the right to rescind the contract or reduce the price.
Customer Data Swiss Activities AG is entitled to collect, store, and process personal data required within the scope of the business relationship, taking appropriate care with sensitive customer data.
Final Provisions If individual provisions of these General Terms and Conditions are ineffective, the validity of the remaining provisions remains unaffected. The invalid provision will be replaced by a new clause that comes as close as possible to the economic effect of the invalid one. The place of fulfilment and jurisdiction for contracts, including these General Terms and Conditions, is Zurich, Switzerland.
